This guarantee is made by B
& M Henderson Ltd (the company) whose registered office
is at:
Jockey Street Works, Accrington Road, Burnley
hereby guarantees that the following slate materials used for roofing
on the following property: |

B & M Henderson Ltd
hereby guarantees it’s slate known as:
Imperial Blue: 6 - 8 mm thickness
|

Providing that the slates have been used and
fixed in accordance with BS 5534 Part 1: 1997 and BS 8000 Part
6; 1990
The Materials
a: have been tested to BS 680 Part 2
b: are free from defects which in normal conditions would render
them
unsuitable for the purpose for which they were originally supplied
Against
c: substantial deterioration in appearance from that when originally
fixed
or
d: excessive delamination or flaking. |

|
This guarantee shall be effective for 60 years from
the date hereof. It is subject to the conditions and exclusions of
the companies liability and limited to the remedies set out in this
document. This Guarantee does not limit the rights of the consumer
dealing as such.
The benefit of this guarantee shall belong to the owners of the above
property at the date hereof and may be transferred to a subsequent
owner by assignment in due form. The Company does not require notice
of such assignment. |

Conditions
1. Any claim under this guarantee must be made immediately
when the fault/ damage is discovered by the the current owner
of the building.
2. Any claim in the first instance should be referred to the
contractor, builder or supplier from whom the slate products
were purchased, if this is not possible then claims should be
forwarded in writing to: B & M HENDERSON Jockey Street Works,
Accrington Road, Burnley, Lancashire BB11 5BD.
3. The benefits afforded by this guarantee are specific to the
Property and cannot be transferred.
4. This Guarantee is invalidated by the use of any slates on
the roof not sold by the company unless such use has prior written
approval from the company.
5. This guarantee does not affect the consumers statutory rights.
6. Purchaser understands that use of this product constitutes
acceptance. |
Exclusions:
1. Any products on the property other than those specifically
mentioned above.
2. Products not used or fixed in accordance with BS 5534 Part
1: 1997 and BS 8000 Part 6: 1990.
3. Fixing Workmanship.
4. Damage or deterioration caused by incorrect handling, accident,
fire, abnormal atmospheric pollution, war, riot or act of God.
5. Damage or deterioration due to lack of integrity in the supporting
structure.
6. Any loss (including consequential loss) except as detailed
under Remedies below.
Remedies:
The company will, as appropriate, in the event of the failure
of the product (as covered under this guarantee and subject
to the Conditions and Exclusions as stated above).
Supply replacement B & M HENDERSON natural slates free of
charge. |
